§ 33.34. DESIGNATION OF MUNICIPAL PROSECUTOR.

  • Unless another officer is designated, the attorney retained as general legal counsel for the municipal corporation shall serve as and have all of the powers and duties of the Municipal Prosecutor as herein referred to. However, the legislative body of the municipal corporation may enter into an agreement under I.C. 36-1-7 empowering, designating and appointing the Prosecuting Attorney for the judicial circuit in which municipal corporation is located (for example, the "County Prosecutor") to serve as Municipal Prosecutor; or may in accordance with I.C. 36-1-3 establish by ordinance a separate office of Municipal Prosecutor (or similar title) and provide therein for the appointment of a different attorney as Municipal Prosecutor.
